Thematic area: Comparison of Public Law, analysis of the legislation in force in the fields of tourism, environment and quality of life.

International and Public Law, comparison between different norms and law enforced in every single country and comparison with Community law. Aside from being owners of cultural and natural attractions, governments are also best equipped to use planning controls and other measures to ensure that development in general is consistent with societal goals, especially in cases of market failure. It is necessary to recognize both the limits and strengths of markets and the limits and strengths of government interventions. In fact, interest in continued growth sometimes leads to the problem of overuse. Overshoot and overdevelopment could bring stagnation and decline. Planning processes and management actions are designed to help destinations avoid overdevelopment. In concrete terms, they are designed to identify potential problems before they become so significant that the resource is unacceptably degraded or access to it needs to be limited or discontinued. Encouragement can take the form of incentives and/or disincentives. Incentives can be direct, such as access to low-interest loans, training programmes or particular attractions. They can also be indirect, such as development of certification programmes that can lead to market advantage relative to non-certified business. Government regulation can also take various forms, ranging from requiring environmental impact assessments to limiting access to attractions and/or destinations as a whole. Development cooperation agencies can play various roles in this process.
